General terms and conditions of sales contract

These General Terms and Conditions of Sale govern the relationship between “the customer” and “Cycloswisstour”.

Airlines

Airlines are always likely to increase their prices (especially if there is an increase in fuel prices). Prices will always be reflected on your bill as long as tickets are not issued. Exchange rates may change. Therefore, we reserve the right to charge these fees on your invoice. If the increase amounts to more than 10% of the agreed price, you have the option to terminate your contract within 5 working days.

In the event that the airline downgrades you, we cannot be held responsible under any circumstances. Under certain conditions, it is possible to ask for compensation. For this reason, you must ask the airline for proof so that you can take the necessary steps.

Responsibility

“Cycloswisstour” acts as a tour operator and is also a reseller of products from qualified Swiss and foreign partners.
“Cycloswisstour” selects its partners based on needs in order to deliver programs and satisfy its clientele.

As far as air transport is concerned, the airlines we propose offer every guarantee of comfort and safety. The many rotations of aircraft and the imperatives of safety, which are paramount, can sometimes lead to delays or changes. Any delay or changes may not result in any compensation from “Cycloswisstour”. However, according to air passengers’ rights, it is imperative to contact the airline to obtain at least a certificate from them. Air tickets are subject to the terms and conditions of the airlines concerned.

If a service provider fails during the tour or stay or if, for compelling reasons, we are obliged to cancel all or part of the agreed commitments, we will do our utmost to replace them with at least equivalent services.

It is the “client”‘s responsibility to ensure that he/she is in compliance with police, customs and health requirements for your travel. We provide information on visas and vaccinations required for each country as a guide, but these requirements are subject to change and are always your responsibility. A passenger who could not board a flight due to failure to present the required documents (passport, visas, vaccination certificate, etc.) or who was refused entry would not be entitled to any refund. For all rentals of cars, apartments, villas or even some hotels, a credit card is required to deposit the deposit on site.

Registration and conclusion of the contract

Your registration becomes effective as soon as you give us your consent, either in writing, by telephone, electronically (e.g. e-mail, Internet, etc.) or in person at one of our booking offices. If you register other participants on the trip, you are responsible for their contractual obligations as well as your own. The contractual agreements and the General Conditions of Travel and Contract apply to all participants on the trip. We are not responsible under any circumstances for any errors in the names of which you have communicated to us. A name change fee will be charged in the case of errors.

Prices and payment arrangements

Prices are subject to various fluctuations: negotiations, changes in demand, exchange rates. Unless otherwise indicated, all our prices are quoted in Swiss francs and at the current price.

At the time of registration you must pay a deposit. This amount is set at the time of booking. The minimum deposit is equal to the total scheduled flights and 35% of the total services. Then 35% 2 months later. The balance will be paid no later than 45 days prior to departure (unless specific and special conditions are mentioned by our partners and/or on the invoice).

For all bookings made less than 45 days prior to departure, the full amount must be paid at the time of conclusion of the contract.

For bookings exceeding a departure date of more than 5 months, “Cycloswisstour” will be able to adjust the payment methods in several requests for deposits.

For applications requiring various searches and therefore the application is not finalized, one or more down payments will be requested to cover the costs and bookings of the various providers.

Methods of payment

You can pay your benefit in one of the following ways:

  • In cash at one of our booking offices
  • Bank transfer
  • Remittance slip
  • By card (Postcard, debit card, Mastercard, Visa)
  • Online payment with our SecurePayGate WORDLINE

Changes on the part of the passenger

If one or more travellers request changes after registration, “Cycloswisstour” will charge a fee of CHF 100.00 per person and a maximum of CHF 1500.00 per file in addition to the changes requested by each service provider. The change fees of the different service providers vary according to the case. (Travel period, date of change, etc.) (If the change consists of an additional service on the same trip, the fee of CHF 150.00 will not be charged. “Cycloswisstour” may waive the fee depending on the nature and prices of changes to the trip.

No reimbursement shall be made for any travel cut short by the traveller or for any service not used by the traveller.

Cancellation by the passenger

Single flights: depending on the conditions of the airline concerned, application fees not included.

Package or à la carte travel:

Cancellations must be sent to us by registered mail. The date of receipt of the letter is as proof of receipt.

In the event of total or partial cancellation of the trip, we charge the following fees:

Up to 90 days before departure: 35% + CHF 100.00 per person
89 to 46 days from departure: 75% + CHF 100.00 fee
45 to 0 days from departure: 100%

In case of cancellation of special offers, cancellation is charged 100%

In the case of a package that includes flights whose tickets were issued prior to the cancellation, an airline cancellation fee will apply in addition to the above mentioned fees. The airline fees vary from case to case and may amount to 100% of the ticket price including taxes.

In the event of total or partial cancellation of the order, we will charge an administration fee of CHF 100.00 per person and a maximum of CHF 500.00 per file.

In the event that the Federal Department of Foreign Affairs (FDFA) advises against travelling to a country or region to which you have already booked a trip, you may change your booking for a certain period of time free of charge. You will not have to pay any cancellation fees.

Interruption of travel by “client”

In the event that you interrupt the journey, return a vehicle before the scheduled date or cancel any other service on site, we will not normally be able to refund you. If the local service providers provide a refund, we will reimburse you the amount specified by the service provider, with a deduction of CHF 100.00 per person from our costs. In order to carry out this type of transaction, we need a written letter from the service provider concerned. We will refund the amount as soon as the provider has returned the amounts to our bank account.

If you miss your plane, boat, train, there is no possibility of refund.

If you miss your return plane, boat or train, you must book your return trip entirely at your own expense. The risk of delay is entirely the responsibility of the traveller.

Replacement passenger

A replacement traveller may be accepted under certain conditions and on the terms and conditions of the service providers. In this case, you may be replaced by another person who agrees to resume your journey under the same conditions. The replacement person must be accepted by all the service providers involved in your travel, in particular the airline.

In all cases, we will charge you the additional costs of the various service providers if they are located, as well as a flat rate of CHF 200.00 per person to be replaced for the various procedures in order to cover the administrative costs.

Flat-rate arrangement

professional contracts we have with our partners and suppliers. In addition, in order to enforce the federal package travel law (protection of the traveller and the travel agency), we are required to provide an overall price per person.

Passport, visa and vaccines

It is your personal responsibility to be in possession of the required travel documents. We inform you about passport and visa requirements as well as health regulations and possible vaccinations. This information can be found on our website or on your travel confirmation or invoice. We do not assume any responsibility if a passenger is unable to fly due to incomplete travel documents. In such cases, there is no right to a refund.

Cycloswisstour will notify you as soon as possible in the event of any changes to the entry requirements and will not be liable for such changes.

In case of refusal of entry into a country Cycloswisstour cannot be held liable, the return journey will be your responsibility and the cancellation clauses apply.

Travel documents

Travel instructions, date, time, appointment, flight number, etc., will usually be communicated to you 10 days prior to your departure. Travel documents (e-ticket, voucher, etc.) are sent by mail, e-mail or delivered to our offices by prior agreement.

Insurance

No insurance is included in our prices, to avoid double coverage. However, we are at your disposal for any questions, information or additional sales of insurance products. Insurance services are governed by the policyholder’s certificate of insurance.

Claims

If the services do not correspond to the description in the catalogue or the offer, or if there is a major defect, you must contact the travel companion or service provider in question (hotelier, rental or local agent) without delay and ask them to rectify the problem.

Any complaint relating to a journey must be addressed to “Cycloswisstour” by registered mail, together with the requested attachments (photos and documents), no later than two weeks after the date of return.

Terms of payment

The payment terms are stipulated on the invoice.

Delays in payment

In the event of late payment a default interest of 5% on the unpaid amount is payable as well as a call-back fee of CHF 40.- per call-back.

We would like to draw your attention to the fact that your personal data may be passed on to third parties, in particular to a collection company in the event of late payment. Please note that any additional costs incurred will be borne by you.

Guarantee Travel

Cycloswisstour is a member of the Guarantee Fund of the Swiss Travel Branch and guarantees to you the collateral of the amounts paid when you book your travel package. The provisions of the Federal Law on Package Travel shall apply. (Excluding flights only).

For Legal

The jurisdiction is exclusively in Neuchâtel.

Applicable law

Swiss law alone is applicable.

REGISTRATION FOR ONE OF OUR TRIPS OR STAYS IMPLIES ACCEPTANCE OF ALL OUR GENERAL TERMS AND CONDITIONS OF TRAVEL AND CONTRACT.
